Terms & Conditions, Cancelation Policy and Payment Agreement
Please Note: Children must be older than 5 years old to go on an ATV tour, 16 and under must ride as passengers (charged as a passenger, not as a driver). Children 16 years and older can drive their own ATV.
Our ATV Tours are very different in the rainy and dry seasons – Tamarindo is extremely dry during the dry season, and there is little or no mud or water. We do our best to ensure each tour is a great experience for all of our guests, regardless of the weather. If you have any questions about the weather conditions, please let us know before booking your tour.
ATV tours require a minimum of two people each riding an ATV. We cannot run a tour with only two people sharing one ATV.
Kayak tours require a minimum of two people each paddling an individual kayak. We cannot run a tour with only two people sharing one kayak.
Surf lessons require a minimum of two people. We cannot offer lessons for one person or two people sharing one surfboard.
Cancellation Policy
If you cancel your tour 15 days or more prior to your reservation date, you will not be charged a cancellation fee.
If you cancel your tour less than 15 days from your reservation date, we reserve the right to charge the full price of the tour to the credit card you used when booking your tour.
If you don’t show up for your reservation, we reserve the right to charge the full price of the tour to the credit card you used when booking your tour.
Please Note
When booking a tour online, your credit card is only used as a deposit to hold your position; you are NOT charged at the time of booking. If you do not show up for your tour, we reserve the right to charge the full price of the tour to the credit card you used when booking your tour. Please pay for your tour in cash when you arrive at our office.
Payment Information Collection Agreement between Customer and ATV/UTV Tour Company
- Collection of Payment Information
1.1 Customer agrees to provide Company with payment information, including credit card details, for the purpose of payment for booking a tour (hereinafter referred to as the “Tour”).
1.2 Company undertakes to process and store payment information in accordance with applicable laws in the United States, Canada, European Union, and Costa Rica, including but not limited to the relevant data protection and privacy laws of each jurisdiction.
- Cancellation of Booking
2.1 In the event of cancellation of the Tour booking, Customer agrees to notify Company in writing within the specified timeframe as outlined in the booking terms. In case of late notification or failure by the Customer to meet the cancellation conditions, Company reserves the right to impose a specified fee, which will be stated in the booking terms.
2.2 Company has the right to withhold a certain amount from Customer’s payment information to cover expenses incurred as a result of the booking cancellation, in accordance with applicable laws in the United States, Canada, European Union, and Costa Rica.
- Damage to or Loss of Vehicles
3.1 Customer agrees to handle the vehicles (ATVs or UTVs) with due care and abide by the safety rules provided by the Company. In the event of damage or loss of the vehicles due to improper use or non-compliance with the rules, Company has the right to charge the Customer’s credit card to cover the expenses for repair or replacement of the vehicles.
3.2 Company assesses the cost of damages or loss, and if such expenses exceed the pre-paid amount, Customer agrees to pay the difference using the provided payment information.
- Liability for Payment Information
4.1 Customer acknowledges that the payment information provided to Company is accurate, complete, and up-to-date.
4.2 Customer bears full responsibility for any errors or inaccuracies in the payment information provided, including incorrect or invalid credit card details.
- Confidentiality
5.1 Company agrees to process payment information in compliance with applicable data protection and privacy laws in the United States, Canada, European Union, and Costa Rica. Company undertakes not to disclose such information to third parties, except as required by applicable laws or with the Customer’s consent.
- Acceptance of Terms
6.1 By clicking the “Agree” or “Accept” button on the Company’s website, Customer signifies their full acceptance of the terms of this agreement.
6.2 Customer confirms that they have read and understood the terms of this agreement and agree to abide by them.
