Agreement to Receive Offers, Discounts, Newsletters, and Other Marketing Communications
**1. Purpose of the Agreement:**
The purpose of this Agreement is to seek the consent of the Recipient to receive marketing communications, including offers, discounts, newsletters, updates, and other promotional information, from Action Tours and its partners.
**2. Recipient’s Consent:**
By signing this Agreement or providing consent through an electronic means, the Recipient voluntarily and explicitly consents to receive marketing communications from Action Tours and its partners, in accordance with the laws of the USA, including California, EU, China, and Costa Rica, where applicable.
**3. Types of Communication:**
Action Tours and its partners may communicate with the Recipient through various means, including but not limited to:
– SMS (text messages)
– Direct mail
– Telephone calls
– Social media channels
**4. Opt-In and Opt-Out Mechanism:**
The Recipient will have the option to opt-in to receive marketing communications, and Action Tours will use a double opt-in process (where applicable) to ensure explicit consent. Additionally, the Recipient will have the right to opt-out of receiving marketing communications at any time. An opt-out mechanism will be provided in each communication, allowing the Recipient to unsubscribe from further marketing materials.
**5. Information Protection:**
Action Tours is committed to protecting the Recipient’s personal information and will comply with applicable data protection laws. The information collected during this process will be handled in accordance with Action Tours’ Privacy Policy and the relevant laws in the USA, including California, EU, China, and Costa Rica.
**6. Third-Party Sharing:**
Action Tours may collaborate with trusted third-party partners to provide the Recipient with valuable offers and promotions. However, the Recipient’s personal information will not be sold, leased, or shared with any unrelated third parties without explicit consent, unless otherwise required by law.
**7. Duration of Consent:**
This consent to receive marketing communications from Action Tours and its partners shall remain valid until the Recipient chooses to exercise their right to opt-out or until required by law.
**8. Governing Law and Jurisdiction:**
This Agreement shall be governed by and construed in accordance with the laws of the USA, including California law, EU law, the laws of China, and the laws of Costa Rica, as applicable. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.
**9. Entire Agreement:**
This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, whether oral or written.
